Zyrcle (operated by Inifex LTD (16543165)) respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512. We respond promptly to notices of alleged copyright infringement that comply with the DMCA.

1. Reporting Copyright Infringement

If you believe that content on zyrcle.com infringes your copyright, you may submit a DMCA takedown notice to our Designated Copyright Agent. Your notice must include all of the following elements required by 17 U.S.C. § 512(c)(3):

Required Elements of a Valid DMCA Notice

  1. Identification of the copyrighted work: A description of the copyrighted work you claim has been infringed, or if multiple works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of the material you claim is infringing and that you want removed, with sufficient detail for us to locate it on the Platform (e.g., the URL of the specific content).
  3. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  4. Good faith statement: A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy statement: A statement that the information in your notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the copyright owner.
  6. Signature: A physical or electronic signature of the copyright owner or a person authorized to act on behalf of the copyright owner.

Warning: Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

3. Counter-Notification Procedure

If you believe that content you posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. Your counter-notification must contain the following elements required by 17 U.S.C. § 512(g)(3):

  1. Identification of removed content: A description of the material that was removed and the location at which the material appeared before it was removed (e.g., the URL).
  2. Statement under penalty of perjury: A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  3. Your contact information: Your full legal name, mailing address, telephone number, and email address.
  4. Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or the District of Wyoming if your address is outside the United States, and that you will accept service of process from the person who provided the original infringement notification.
  5. Signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward it to the original complaining party. If the complaining party does not notify us within 10–14 business days that they have filed an action seeking a court order to restrain the allegedly infringing activity, we may restore the removed content.

4. Repeat Infringer Policy

In accordance with 17 U.S.C. § 512(i), Zyrcle maintains and enforces a repeat infringer policy. Accounts with multiple substantiated copyright infringement complaints will be permanently terminated. Zyrcle reserves the right to terminate accounts of users who repeatedly infringe or are alleged to infringe the copyrights of others, even without formal DMCA notices in all instances.

5. Standard Processing Timeline

  • Acknowledgment: Within 2 business days of receiving a complete, valid notice.
  • Action: Removal or disabling of infringing content within 5 business days of acknowledgment, or sooner where technically feasible.
  • Notification: Affected creator is notified of the removal and their right to submit a counter-notification.
  • Counter-notification period: 10–14 business days after forwarding a valid counter-notification to the original complainant before potential restoration.
